This Agreement sets forth the legally binding terms and conditions for your use of the Site at https://everhostai.live/ if, for any reason, you do not want to agree to these Terms & Conditions, you must not access or use our Site in any manner.
By using this Site or accessing any of our services, you consent to these Terms of Service, including, without limitation all terms herein regarding our collection, use and data storage as specified in our Privacy Policy.
By Purchasing Our Product you agree to receive promotional emails for new offers that may contain affiliate link.
Service Use:
All Services may only be used for lawful purposes. The laws of the United States of America apply to all Clients of EverHost.
You agree to indemnify and hold harmless EverHost from any claims resulting from your use of EverHost Services. You represent and warrant to EverHost
that you are eighteen (18) years of age or older. Any use of or access to the Services by anyone under eighteen (18) years of age is prohibited.
If you use the Services on behalf of another party, you agree that you are authorized to bind such other party to this Agreement
and to act on such other party's behalf with respect to any actions you take in connection with the Services.
Use of the EverHost Services to infringe upon any copyright or trademark is prohibited. This includes but is not limited to unauthorized copying of music, books, photographs,
or any other copyrighted work. The offer of sale of any counterfeit merchandise of a trademark holder will result in the immediate termination of your account.
Any account found to be in violation of another's copyright will be expeditiously removed, or access to the material disabled.
Any account found to be in repeated violation of copyright laws will be suspended and/or terminated from our hosting.
If you believe that your copyright or trademark is being infringed upon, please email abuse@hostwinds.com with the information pertaining to your claim.
Using a account as a backup/storage device is not permitted, with the exception of one CWP backup of the same account. Please do not take backups of your backups.
Examples of unacceptable material on all Shared, Business and Reseller servers include:
X IRC Scripts/Bots
Proxy Scripts/Anonymizers
Pirated Software/Warez
Image Hosting Scripts (similar to Photobucket or Tinypic)
IP Scanners
Bruteforce Programs/Scripts/Applications
Mail Bombers/Spam Scripts
File Dump/Mirror Scripts (similar to Rapidshare)
Sale of any controlled substance without prior proof of appropriate permit(s)
Lottery/Gambling Sites
Sites promoting illegal activities
Forums and/or websites that distribute or link to Warez/pirated/illegal content.
Fraudulent Sites (Including, but not limited to sites listed at aa419.org & escrow-fraud.com).
All of the files on our hosting accounts must pertain to your website(s). This space may only be used for web files, active emails, and content of Client Websites.
EverHost hosting may not be used for massive file storage systems, or backup storage solutions (including media files, emails, or other data).
You are not authorized to use EverHost for the hosting of download mirrors. You may have files for your clients/users/ to use; however,
if your website is based around users downloading files, you will need to upgrade to a VPS Package with a link to our managed Linux page.
It is your responsibility to ensure that scripts/programs installed under your account are secure, and permissions of directories are set properly,
regardless of installation method. When at all possible, you must set permissions on most directories to 755 or as restrictive as possible.
Clients are responsible for all actions taken under their account. This includes the compromise of credentials such as Client name and password.
You must use a secure password.
Solely for the purpose of providing the Services, you hereby grant to EverHost the right and license to access, store and use any content provided by you,
and to remove all or any portion of such content if you violate the provisions of this Agreement.
EverHost may from time to time, and at any time, monitor your use of the Services to ensure your compliance with the provisions of this Agreement.
Zero-Tolerance SPAM Policy
EverHost has zero-tolerance for Clients sending unsolicited e-mail, unsolicited e-mailing, and SPAM. "Safe lists," purchased lists, and selling of lists will be treated as SPAM.
Any Client who sends out SPAM will have their account terminated, and may be terminated without notice. Additionally, Clients who engage in unsolicited mailing will, at EverHost' own discretion,
be charged a consulting fee of two hundred fifty dollars ($250) per hour for any remedial actions that EverHost elects to take in the event that, as a result of a Client's activities,
EverHost servers or IP space are placed in any third-party mail filtering software or blackhole lists.
To protect the IP reputation of our network, and as a proactive measure to prevent our IP space from being used to distribute unsolicited e-mail,
EverHost reserves the right to apply an SMTP filter as a precaution to accounts flagged by our Abuse Team.
Backups and Data Loss
Your use of EverHost Services is at your sole risk. EverHost servers are setup with RAID to constantly mirror all data to a second disk.
EverHost is not responsible for files and/or data stored on EverHost servers. You agree to take full responsibility for files and
data transferred and to maintain all appropriate backups of files and data stored on EverHost servers. EverHost does not take backups
of any kind of customer data, customer's are responsible for managing and backing up their own data.
Unlimited Hosting Policy
For security reasons our team will verify your account when you reach the 10 domain limit.
EverHost will allocate an unlimited amount of disk space and bandwidth for our Shared, Business, Reseller, and White Label Reseller services.
That unlimited disk space and bandwidth may only be used to store and transfer files relevant to the website(s) being hosted on those services.
If a Client causes continuous server or service interruptions under their current plan, they will be asked to upgrade to a more powerful plan.
In the event that such interruptions are being caused, we would notify the Client, informing them they need to upgrade.
In extreme cases, the service would be suspended to prevent further server or service interruptions. The service would also be suspended
if the Client does not contact us after warning emails regarding the need to upgrade have been sent.
Server Abuse/Customer Abuse
Any attempted attack against any EverHost server and/or Client being hosted by EverHost will result in automatic termination
of the offending account with no refund including, but not limited to, no refunds for advanced payments,
and a permanent banning of the offending Client.
The Site allows you to access and use Our Services subject to these Terms and for Personal and/or Commercial Use. Additionally, you may not create more than the allotted number of account per Individual/Business and you may not access any account other than your own. We may at our sole discretion and at any time without prior warning, discontinue providing the Services without notice.
By using our Services, you represent and warrant that
Any and all registration information you submit is truthful and accurate
You will maintain the accuracy of such information
Your use of our Services does not violate any applicable law or regulation or any obligation
Account Registration
You may register to access and use our Services by verified email address through our Account Registration Page.
In consideration of your Registration and use of the Service, you agree to:
Provide true, accurate, current and complete information about yourself as prompted by the Service's registration form (such information being the "Registration Data"), and
Maintain and promptly update the Registration Data to keep it true, accurate, current and complete.
If you provide any information that is untrue, inaccurate, not current or incomplete, or Information, which we have reasonable grounds to suspect that such is untrue, inaccurate, not current or incomplete, this will be removed as per our Account Termination Policy.
Your Responsibilities:
Your use of our Services must comply with our Acceptable Use Policy. Content in the Services may be protected by others’ intellectual property rights. Please don’t copy, upload, download, or share content unless you have the right to do so.
Data Loss:
You agree to take full responsibility for files and data transferred and to maintain all appropriate backups of files and data stored on EverHost servers. EverHost does not take backups of any kind of customer data, customer's are responsible for managing and backing up their own data.
Account Termination
You hereby agree that we may for any reason and at our sole discretion and without notice, terminate your account, and remove from the Services any content associated with your account.
Grounds for termination may include but not limited to:
Violation of the letter or spirit of these Terms
Unreasonable account usage
Fraudulent, harassing or abusive behavior
Promotion of adult content
If we believe, in our sole discretion, that a violation of these Terms or any illegal or inappropriate behavior has occurred, we reserve the right to investigate and may take any other corrective action we deem appropriate including Account Termination.

All Subscriptions will be renewed Automatically. At the end of the Billing period, we will sign you up and bill you for an additional and equivalent subscription term. You may change your auto-renewal preferences in your Account.
Payments
The use of Our Services is subject to payments being Received & Cleared in accordance with the Services that have been ordered. We currently accept PayPal and major credit cards for payments on all services offered by us through a third party payment processor.
Please note that you are solely responsible for any taxes/surcharges on amounts you are required to pay in order to obtain services through our Website.
To protect against fraud, unauthorized transaction e.g. money laundering, claims or other liabilities, we do not collect credit card information but allow our Payment Processor; PayPal to collect the information for the sole purpose of collecting payments from buyers on the Site. We are not exposed to payment information provided by PayPal and/or other Payment Providers and this information is subject to their Privacy Policy.
Cancellation & Refund Policy
We want you to be fully satisfied with all Services you purchase from AC Development. If you are not satisfied with your purchase, you may request within 30 days from date of purchase for a full refund of the purchase price, minus processing or other additional charges.
Any order cancelled after the initial 30-day period will not be eligible for a refund.
Intellectual Property
The Site and its original content, features and functionality are owned by AC Development. and are protected by international copyright, trademark, patent, trade secret and other intellectual property or proprietary rights laws.
Termination
We may terminate your access to the Site, without cause or notice, which may result in the forfeiture and destruction of all information associated with you. All provisions of this Agreement that by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

The Website is provided on an AS IS and AS AVAILABLE basis without any representation or endorsement made and without warranty of any kind whether express or implied, including but not limited to the implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security and accuracy.
To the extent permitted by law, AC Development. will not be liable for any indirect or consequential loss or damage whatever (including without limitation loss of business, opportunity, data, profits) arising out of or in connection with the use of the Website.
We make no warranty that the functionality of the Website will be uninterrupted or error free, that defects will be corrected or that the Website or the server that makes it available are free of viruses or anything else, which may be harmful or destructive.
Governing Law
This Agreement (and any further rules, policies, or guidelines incorporated by reference) shall be governed and construed in accordance with the laws of the India, without giving effect to any principles of conflicts of law.
Disclaimer
EverHost AI shall not be responsible for any damages a Client's business may suffer. This includes loss of data resulting from delays, no deliveries, wrong delivery, and any and all service interruptions caused by EverHost AI and its Clients. EverHost AI makes NO WARRANTIES of any kind, expressed or implied for Services provided. EverHost AI makes NO WARRANTIES of MERCHANTABILITY or FITNESS for a particular purpose.
Changes to This Agreement
We reserve the right, at our sole discretion, to modify or replace these Terms and Conditions by posting the updated terms on the Site. Your continued use of the Site after any such changes constitutes your acceptance of the new Terms and Conditions.
Please review this Agreement periodically for changes. If you do not agree to any of this Agreement or any changes to this Agreement, do not use, access or continue to access the Site or discontinue any use of the Site immediately.
